Terms & Conditions
Art. 1 Scope and provider
These General Terms and Conditions (T&C) apply to all contracts and services between the provider and its customers (both consumers and entrepreneurs) via the website Rautner 1808 as well as via all related communication channels.
Provider:
Rautner 1808 ??
Rautner 1808
Rentscher Straße 74
I-39100 Bozen, Südtirol
E-mail: info@rautner1808.com
Phone: +39 0471 279000
Authorised representative: ??
Deviating, supplementary or conflicting terms only become part of the contract with the provider's express written consent. The version in force at the time the contract is concluded is decisive.
Art. 2 Subject matter
The provider delivers the services described on Rautner 1808 or agreed individually. The presentation on the website does not constitute a legally binding offer but a non-binding invitation to make an offer (invitatio ad offerendum).
Art. 3 Conclusion of contract
The contract is formed upon the provider's express acceptance of the customer's offer (e.g. by e-mail, order confirmation or by conclusive performance of the service). An automatic acknowledgement of receipt of enquiries does not yet constitute acceptance.
Art. 4 Prices and terms of payment
Unless expressly stated otherwise, all prices are in euros and include the legally applicable VAT.
Invoices are due for payment within NaN days of the invoice date without deduction. Accepted payment methods: ??. In the event of default in payment, the statutory rules on default apply (in particular D.Lgs. 231/2002 in B2B transactions). Set-off is only permitted with undisputed or legally established claims.
Art. 5 Performance, cooperation and acceptance
The service is performed with the diligence customary in the industry in accordance with the generally recognised rules of technology. Deadlines are only binding if they have been expressly agreed in writing.
The customer provides all information, data and materials required for the provision of the service in good time and in full. Delays due to a lack of cooperation are at the customer's expense.
Insofar as the nature of the service requires formal acceptance, this is deemed to have taken place tacitly if the customer uses the work result productively or does not report legitimate defects within 14 days of handover.
Art. 6 Right of withdrawal for consumers (distance contracts)
Only consumers have, for contracts concluded at a distance, a right of withdrawal of 14 days from the conclusion of the contract. To meet the deadline, it is sufficient to send a clear statement in good time to: Rautner 1808 ??, Rautner 1808
Rentscher Straße 74
I-39100 Bozen, Südtirol — E-mail: info@rautner1808.com
After effective withdrawal, payments made will be refunded without delay, at the latest within 14 days of receipt of the withdrawal statement, using the same payment method. The right of withdrawal expires prematurely for services that have been fully rendered if the consumer has expressly agreed to performance before the expiry of the withdrawal period and has confirmed knowledge of the expiry of the right of withdrawal. The same applies to digital content not supplied on a tangible medium.
Art. 7 Liability
Liability for intent and gross negligence as well as for damages arising from injury to life, body or health is unlimited. In the case of slight negligence, liability is limited to the breach of material contractual obligations and limited in amount to the foreseeable damage typical of the contract. Mandatory statutory liability provisions remain unaffected.
Art. 8 Intellectual property and rights of use
All work results (e.g. texts, concepts, designs, software, media) are subject to copyright. Works created in the course of providing the service are granted to the customer as a simple, non-transferable right of use for the agreed purpose.
There is no obligation to hand over open working files, drafts or raw data unless this has been expressly agreed by contract.
Art. 9 Data protection
The processing of personal data takes place in accordance with the GDPR and the Italian data protection law. Details are set out in the separate Privacy Policy.
Art. 10 Dispute resolution
The European Commission provides an online dispute resolution (ODR) platform: ec.europa.eu/consumers/odr. The provider's e-mail address: info@rautner1808.com.
The provider does not regularly participate in dispute resolution proceedings before a consumer arbitration board. For certain disputes in Italy, mandatory mediation under D.Lgs. 28/2010 applies.
Art. 11 Final provisions
Italian law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the consumer's country of residence remain unaffected.
The place of performance and jurisdiction for disputes with entrepreneurs (B2B) is Bozen ??; for consumers (B2C), the statutory venue at the consumer's place of residence applies mandatorily. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
Changes to these T&C will be communicated in a suitable manner. If no objection is raised within 30 days, the changes are deemed accepted.
Art. 12 Contact

These T&C cover general services in the B2B and B2C area. For the pure online sale of physical goods (e-commerce), legally required mandatory information on shipping, return costs and warranty is missing. Note for Italy: for the legally secure enforcement of the limitation of liability (Art. 7) and the place of jurisdiction (Art. 11), the customer must separately approve these clauses upon conclusion of the contract ("Double signature" / Clausole Vessatorie pursuant to Art. 1341/1342 of the Codice Civile).
